Case #105: Erroneous Disability Certificate

Vulnerable group: people with disabilities

Human rights area: administrative law, disability benefits

County: Dolj

A new request for pro bono legal assistance has been taken over through The Pro Bono Network for Human Rights. Until 2002, the person in question held a certificate of disability attesting the accentuated degree of his disability (second most severe from the fourth degrees recognised in Romanian legislation). Following a revision of the certificate, it has been changed to attest a medium degree (third most severe). The applicant claims that this conclusion was reached without the proper assessment of his health. Meanwhile, his health worsened, forcing him to give up his job and his doctoral studies. He currently holds a non-reviewable certificate of disability for medium degree and wishes to regain the accentuated degree.

Săuleanu and Associates Law Firm, from Dolj County, is offering legal assistance to the applicant in this case and supporting him in gaining the rights he is entitled to.
