CASE #18 THE RIGHT TO A PERSONAL CAREGIVER FOR PERSONS WITH DISABILITIES

Mr. C and his wife are elderly people and they live in Mureş County. He suffers from Parkinson disease and his wife is his main caretaker. The law allows his wife to be hired as her husband’s personal caregiver, but only if he obtains the certificate for “highest level of disability with personal caregiver”. Since 2015, when the evaluation commission gave him the “accentuated disability” certificate and until 2016, when the same commission appointed him with an even lower degree of disability – “medium disability” – Mr. C has been fighting a battle with the authorities to have his rights recognised: Parkinson disease is not curable and Mr. C is in need of permanent assistance.

Pro Bono Attorney at Law Dora Călian is helping Mr. and Mrs. C take the necessary steps towards the reevaluation of the man’s health condition, so both of them can benefit from the rights the law guarantees them.
