Case Study #1 Pro bono legal aid: Failure of judicial bodies to investigate a serious case of physical violence against a woman attacked on the street by a stranger

The following story is completely real and belongs to a beneficiary of ACTEDO's pro bono legal assistance program, The Pro Bono Network for Human Rights, the largest pro bono legal clearinghouse in the country, dedicated to vulnerable people whose fundamental rights have been violated.

About 3 years ago, Elena was attacked and assaulted on the street by an unknown man.

As a result of the aggression, Elena underwent two surgeries and needed 212 days of medical care, her physical, mental and emotional health being seriously affected. At the time, she filed a complaint with the police and took the necessary steps for the investigation, but to date, the case has not been resolved, and Elena has not received any information about her file.

"It's very difficult for me to relive those moments, even telling stories, because they were simply dramatic, so they changed my life 180 degrees! My life has become a nightmare since then. […]

The doctor told me on the day of the operation, "You only have a 25% chance of ever walking on your own two feet again!" […]

I often have panic attacks. If someone unknown approaches, tries to get closer to me, I immediately panic because I'm afraid I'll be attacked again."

Elena, the beneficiary

"He didn't get any kind of support from the police and the investigations are taking a long time. Now that I intervened and that he has a lawyer, things have moved a little more, but very, very hard.[…]

The law must be changed and this possibility given to those who want to carry out this activity [i.e. pro bono advocacy] to do it for the good of those who need us."

Gabriela Bejan, lawyer at the Bucharest Bar
